1. Agreement to Terms

By accessing or using the NoxHash platform ("Platform"), operated by NoxHash ("Company," "we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Risk Disclosure statement.

If you do not agree with any part of these Terms, you must not access or use the Platform. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of those changes.

These Terms constitute a legally binding agreement between you and NoxHash. We reserve the right to update or modify these Terms at any time, and such changes will be effective immediately upon posting to the Platform.

2. Eligibility

To use the NoxHash Platform, you must meet all of the following requirements:

• You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is greater).
• You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
• You must not be located in, or a resident of, any jurisdiction where cryptocurrency mining, trading, or related activities are prohibited or restricted by law.
• You must not be subject to any economic sanctions, trade restrictions, or designated on any prohibited party list maintained by any government authority.
• You must not have been previously suspended or removed from the Platform for violation of these Terms.

By using the Platform, you represent and warrant that you meet all eligibility requirements. NoxHash reserves the right to verify your identity and eligibility at any time and to refuse service at its sole discretion.

3. Account Registration & Security

To access the mining rental services, you must create an account by providing accurate, current, and complete information during registration. You agree to maintain and promptly update your account information to keep it accurate and complete.

You are responsible for:

• Maintaining the confidentiality of your account credentials, including your password.
• All activities that occur under your account, whether or not authorized by you.
• Immediately notifying NoxHash of any unauthorized use of your account or any other security breach.
• Ensuring that you log out of your account at the end of each session, particularly on shared or public devices.

NoxHash will not be liable for any loss or damage arising from your failure to comply with this section. Each individual may maintain only one account. Duplicate accounts may be suspended or terminated without notice.

4. Mining Machine Rental Services

NoxHash provides a cloud-based mining rental service that allows users to rent ASIC mining hardware hosted in our data center facility in Kazakhstan. The following describes the core aspects of our rental model:

4.1 Service Description

When you rent a mining machine through NoxHash, you are renting access to a physical ASIC miner (such as the Antminer S21, WhatsMiner M60, or WhatsMiner M66) operated and maintained at our facility. NoxHash handles all hardware provisioning, maintenance, electricity costs, cooling, and operational management. You receive the Bitcoin (BTC) mining output generated by your rented machine, less applicable fees.

4.2 Machine Tiers

NoxHash offers the following rental tiers, each providing different levels of hashrate and mining output:

4.3 Rental Durations & Discounts

Rental contracts are available in the following durations, with longer commitments receiving volume discounts:

• 1 month — Standard pricing (no discount)
• 3 months — 5% discount on the monthly rate
• 6 months — 10% discount on the monthly rate
• 12 months — 15% discount on the monthly rate
• 24 months — 20% discount on the monthly rate

All rental durations are prepaid for the full term. Rental fees are non-refundable once the mining machine has been provisioned and activated, except as otherwise stated in these Terms.

4.4 Service Availability

NoxHash targets 99.9% uptime for all rented machines. In the event of hardware failure, we will replace the affected machine within 4-8 hours. Scheduled maintenance windows will be communicated in advance. NoxHash is not liable for downtime caused by force majeure events, including but not limited to natural disasters, power grid failures, or government actions.

5. Payments & Deposits

All payments on the NoxHash Platform are processed in USDT (Tether) via the following supported blockchain networks:

• TRC-20 (TRON network)
• BEP-20 (BNB Smart Chain)

Key payment terms:

• Deposit process: When you initiate a deposit, the Platform generates a unique wallet address and a deposit amount. You must send the exact amount to the specified address within the allotted time.
• Payment verification: Deposits are verified automatically through blockchain confirmation. The number of required confirmations varies by network.
• Expiration: Each deposit request has a 30-minute expiration window. If payment is not received and confirmed within this period, the deposit request will expire and you must initiate a new one.
• Incorrect amounts: If you send an incorrect amount, please contact support immediately. Recovery of funds sent to incorrect addresses or on unsupported networks is not guaranteed.
• No fiat payments: NoxHash does not accept fiat currency (USD, EUR, etc.) directly. All transactions are conducted in cryptocurrency.

NoxHash reserves the right to modify accepted payment methods, networks, and processing times at any time with reasonable notice to users.

6. Mining Earnings & Withdrawals

6.1 Earnings

Mining earnings are calculated based on the actual hashrate output of your rented machine and the prevailing Bitcoin network conditions, including network difficulty and block reward. Earnings are denominated in Bitcoin (BTC) and accumulate in your NoxHash wallet in real time.

Displayed earnings estimates on the Platform are approximations only. Actual earnings may vary due to fluctuations in Bitcoin price, network difficulty adjustments, pool luck, and other factors beyond NoxHash's control.

6.2 Withdrawals

You may withdraw your accumulated BTC earnings to an external Bitcoin wallet address at any time, subject to the following conditions:

• Withdrawal fee: A processing fee of 1.5% is deducted from each withdrawal amount.
• Minimum withdrawal: The minimum withdrawal amount is 0.00001 BTC.
• Processing: Withdrawal requests are subject to administrative review and approval. While most withdrawals are processed promptly, NoxHash reserves the right to take up to 72 hours for review, particularly for large or unusual withdrawal requests.
• Wallet address accuracy: You are solely responsible for providing a correct and valid BTC wallet address. NoxHash cannot recover funds sent to an incorrect address.

NoxHash reserves the right to temporarily suspend withdrawals for security purposes, system maintenance, or regulatory compliance.

7. Free Trial Terms

NoxHash offers a free trial to allow new users to experience the platform before committing to a paid rental. The trial is subject to the following terms:

NoxHash reserves the right to modify, suspend, or discontinue the free trial offer at any time without prior notice.

8. Affiliate Program

NoxHash operates an affiliate referral program that allows registered users to earn commissions by referring new paying customers to the Platform. Participation in the affiliate program is subject to the following terms:

• Commission rate: Affiliates earn a 20% commission on the rental fees paid by referred users for their initial rental purchase.
• Referral tracking: Referrals are tracked via unique affiliate links with a 30-day cookie duration. A referred user must sign up and complete a qualifying purchase within 30 days of clicking the affiliate link for the commission to be credited.
• Commission payment: Earned commissions are credited to your NoxHash wallet and are subject to the same withdrawal terms as mining earnings.
• Self-referrals: You may not refer yourself or use your own affiliate link for your own purchases. Self-referral commissions will be voided.
• Prohibited promotion methods: Affiliates must not use misleading advertising, spam, or any deceptive practices to generate referrals. Affiliates must not bid on NoxHash branded keywords in paid search campaigns.
• Termination: NoxHash reserves the right to suspend or terminate affiliate accounts that engage in fraudulent activity, and to withhold or reclaim commissions earned through fraudulent referrals.

NoxHash may modify the commission structure, cookie duration, or other program terms at any time. Changes will be communicated to active affiliates and take effect upon posting.

9. Prohibited Activities

You agree not to engage in any of the following activities while using the NoxHash Platform:

• Using the Platform for money laundering, terrorist financing, or any illegal purpose.
• Creating multiple accounts, whether for obtaining additional trial access, manipulating the affiliate program, or circumventing account restrictions.
• Attempting to gain unauthorized access to other users' accounts, NoxHash systems, or any connected networks.
• Interfering with or disrupting the integrity or performance of the Platform or its underlying infrastructure.
• Reverse engineering, decompiling, or disassembling any aspect of the Platform's software or systems.
• Using automated scripts, bots, or scrapers to access the Platform or collect data without express written permission.
• Impersonating NoxHash, its employees, or other users.
• Submitting false, misleading, or fraudulent information, including during account registration or identity verification.
• Using the Platform to transmit malware, viruses, or other harmful code.
• Reselling, sublicensing, or redistributing access to your rented machines without authorization.

Violation of any prohibited activity may result in immediate account suspension or termination, forfeiture of wallet balances, and referral to appropriate law enforcement authorities.

10. Intellectual Property

All content, features, and functionality of the NoxHash Platform — including but not limited to the website design, text, graphics, logos, icons, software, and source code — are the exclusive property of NoxHash or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use in accordance with these Terms. This license does not include the right to:

• Modify, copy, or create derivative works based on the Platform or its content.
• Use any data mining, robots, or similar data gathering tools on the Platform.
• Download, reproduce, or redistribute any portion of the Platform except as expressly permitted.
• Use the NoxHash name, logo, or branding without prior written consent.

11. Disclaimer of Warranties

Without limiting the foregoing, NoxHash makes no guarantees regarding mining returns or profitability. Mining earnings depend on numerous factors outside our control, including but not limited to:

• Bitcoin price volatility and market conditions.
• Bitcoin network difficulty adjustments.
• Block reward halvings and changes to the Bitcoin protocol.
• Global hashrate competition.
• Mining pool performance and luck variance.

Any earnings projections, estimates, or historical performance data displayed on the Platform are provided for informational purposes only and do not constitute a guarantee of future results. Past performance is not indicative of future earnings.

12. Limitation of Liability

To the maximum extent permitted by applicable law, NoxHash, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or anticipated savings.
• Loss of or damage to cryptocurrency holdings.
• Business interruption or loss of business opportunity.
• Damages arising from unauthorized access to or alteration of your transmissions or data.
• Any other intangible losses arising from your use of or inability to use the Platform.

In no event shall NoxHash's total aggregate liability to you exceed the total amount of fees you have paid to NoxHash in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

13. Risk Disclosure

Cryptocurrency mining and related activities involve substantial financial risk. By using the NoxHash Platform, you acknowledge and accept the following risks:

• Market risk: The value of Bitcoin and other cryptocurrencies can fluctuate dramatically. Prices may decline significantly over short periods, potentially resulting in losses that exceed your rental fees.
• Regulatory risk: Cryptocurrency regulations vary by jurisdiction and are subject to change. New laws or regulations may adversely affect the operation of the Platform or the value of your earnings.
• Technology risk: Mining hardware may fail, software may contain bugs, and network conditions may change in ways that affect mining output.
• Operational risk: External factors such as power outages, natural disasters, or political instability in the region of operation may temporarily or permanently disrupt mining operations.

You should only use funds that you can afford to lose entirely. NoxHash strongly recommends that you conduct your own research and consult with a qualified financial advisor before using our services.

14. Termination

Either party may terminate this agreement as follows:

14.1 Termination by You

You may close your account at any time by contacting support through your dashboard. Upon account closure:

• Any active rental contracts will continue to run until their expiration date. Prepaid rental fees are non-refundable.
• You must withdraw any remaining BTC balance from your wallet before account closure, or within 30 days of submitting a closure request.
• After 30 days, unclaimed balances may be forfeited.

14.2 Termination by NoxHash

NoxHash may suspend or terminate your account immediately, without prior notice, if:

• You violate any provision of these Terms.
• You engage in prohibited activities as defined in Section 9.
• We are required to do so by law or regulatory authority.
• We reasonably believe your account has been compromised or is being used fraudulently.
• You fail to complete identity verification when requested.

In the event of termination for cause, NoxHash reserves the right to withhold or freeze remaining wallet balances pending investigation. If no violation is confirmed, remaining funds will be released to you.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Astana, Kazakhstan.

You agree to attempt to resolve any dispute informally by contacting NoxHash support before initiating formal legal proceedings. If a dispute cannot be resolved informally within 30 days, either party may proceed with formal dispute resolution.

Notwithstanding the foregoing, NoxHash reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

16. Changes to Terms

NoxHash reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Post a notice on the Platform or send a notification to your registered email address.
• Provide at least 14 days' notice before material changes take effect, unless the change is required by law or relates to the addition of new features or services.

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree with the updated Terms, you must stop using the Platform and close your account.

We recommend reviewing these Terms periodically to stay informed of any updates.
